PERSONAL DATA PROTECTION

In compliance with Regulation (EU) 2016/679 on the protection of personal data and the French Data Protection Act of January 6, 1978, ATREAM is responsible for the processing of personal data carried out within the scope of its activity.
These legal notices clearly and simply reflect and describe our policy in this regard and inform you about the conditions under which Atream, as data controller, collects and uses your personal data in accordance with data protection principles and the means available to you to control this use and exercise your rights.

Purposes of personal data processing

Atream collects personal data as part of its activity in compliance with the following purposes:
  • Management of the relationship with the partners and investors of the vehicles managed by Atream,
  • The exercise of remedies and the management of complaints from clients and partners
  • Management of its clients and prospects from the pre-contractual phase and for the execution of the contract
  • Commercial prospecting
  • Compliance with its obligations regarding the fight against money laundering and terrorist financing and satisfaction of AMF obligations
  • Management and processing of any conflicts of interest that may harm the interests of its clients
Personal data collected in subscription forms are mandatory for subscribing to the products and services offered by Atream. Otherwise, subscription requests cannot be processed (Recital 47 of GDPR and Article 6 of GDPR).

Legal bases for data processing

Data is collected and used on the basis of the following legal grounds:
  • Legal obligation : when data is collected to comply with Atream’s legal obligations, particularly regarding the fight against money laundering and terrorist financing
  • Legitimate interest: when data is collected for
  • Contract: when data is collected to enable the conclusion and execution of a contract or agreement
  • Consent: when your agreement is necessary to collect and use your data, particularly for commercial prospecting

Recipients

The data collected will be communicated to the following recipients only:
  • authorized Atream employees responsible for managing partners, and for the conclusion, management, and execution of contracts;
  • management delegates, partners, subcontractors, IT service providers;
  • parties involved in the contract such as lawyers, experts, judicial officers, curators, guardians, investigators, consultants, and authorized personnel;
  • where applicable, the relevant courts, arbitrators, mediators;
  • the relevant ministries, supervisory and regulatory authorities, and all public bodies authorized to receive them;
  • departments responsible for control, such as statutory auditors and internal auditors, as well as internal control departments.

Retention periods for your data

Data is retained for a period not exceeding that necessary for the purposes of processing, and in any event, it will not be kept beyond the applicable statutory limitation periods.

In accordance with current regulations, you have the following rights

  • to be informed about data collection
  • to access and rectify the personal data collected,
  • to request the erasure of personal data collected,
  • to request the restriction of data processing,
  • to request data portability,
  • to object to the processing of your data,

All requests will be reviewed, and we will respond within the legal timeframes. We may ask you to provide proof of identity to confirm your identity before responding to your request.

Please note, however, that certain data may be excluded from these requests under certain circumstances, particularly if we need to continue processing your data to serve our legitimate interests or comply with a legal obligation.

In case of disagreement regarding our use of your personal data, we invite you to contact our services to present your requests or grievances.

In accordance with the provisions of Article L. 561-45 of the Monetary and Financial Code, the right of access to processing operations carried out solely for the purpose of applying provisions relating to the fight against money laundering and terrorist financing is exercised with the CNIL through an indirect access right procedure by writing to the address mentioned below. Processing operations carried out to identify persons subject to an asset freeze or financial sanction remain subject to the direct access right procedure with the data controller.
